Legal Disclaimers:

Sable Systems instruments and/or software are not intended for use in life support or mission-critical systems, or in clinical or diagnostic applications. Use of any of our products in such applications is not supported by Sable Systems.

Use of any Sable Systems product is at the user’s sole risk and discretion. In no event shall Sable Systems be liable for any damages of any kind, incidental or consequential, regardless of the legal theory applied, caused directly or indirectly by our products or their instructions or associated components and materials.

Warranty Policy: 

Promethion Line: products are warranted to be free from manufacturer defect for three (3) years from date of purchase. Exclusions from warranty: The three (3) year warranty excludes items which carry a warranty from the original manufacturer. Air filters, tubing, external tubing connectors and desiccants are considered consumable supplies and carry no warranty.

Classic Line / Field Line: In addition to our customary three-year warranty from date of purchase, prices for the quoted equipment items include lifetime technical support by phone, fax or email. Exclusions from warranty: The three year warranty excludes items which carry a warranty from the original manufacturer. Fuel cell sensors in the FC-10, Oxzilla II, FOXBOX, TurboFox and ROXY-1S (18 month warranty), infra-red sources in the CA-10, FOXBOX-C, TurboFOX, CM-10, or MA-10 (1 year warranty), pump assemblies (1 year warranty). Air filters, tubing, external tubing connectors and desiccants are considered consumable supplies and carry no warranty. LIMITATION OF WARRANTIES

Seller (Sable Systems International, Inc.) makes no warranties of any kind other than what is expressly noted herein and on our web site. In no event shall Seller be responsible for any damages suffered by the buyer arising out of buyer’s own negligence or willful acts or failure to act in connection with the storage, handling or use of Sable Systems instruments by buyer or its transferee of risk of loss or damage thereto.

Limitation of Remedies:

Sable Systems shall not be liable under any circumstances for any special, consequential, incidental, punitive or exemplary damages arising out of or in any way connected with this agreement to sell goods to buyer of the goods, including, but not limited to, damages for lost profits, loss of use, lost data, or for any damages or sums paid by buyer to third parties, even if Sable Systems has been advised of the possibility of such damages. The foregoing limitation of liability shall apply whether the claim is based upon principles of contract, warranty, negligence, or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise.

Update Policy:

Sable Systems International continuously improves and updates its instruments, and reserves the right to substitute an equivalent or superior instrument if the instrument being ordered has been updated and/or improved. Please understand that because updating often involves fundamental re-design, Sable Systems is not obliged to update instruments that have already been purchased. Updates will be made available on a case-by-case basis where practical. The availability of such updates in particular cases shall not be construed as precedent for the availability of updates in general.

Sable Systems International offers free telephone and email technical support to end users of our products who have training and background in science and/or laboratory practice. Unsolicited Ideas Submission Policy: 

If you wish to market an idea for new or improved products or technologies, product enhancements, processes, advertising campaigns, new promotions, materials, marketing plans or new product names, please do not send it to Sable Systems International without first contacting us and asking in broad, non-specific terms whether we might be interested in further communications regarding your idea. Sable Systems International or any of its employees do not accept or consider the unsolicited marketing of ideas, including ideas for new or improved products or technologies, product enhancements, processes, advertising campaigns, new promotions, materials, marketing plans or new product names. Please do not send, unsolicited, any original creative artwork, suggestions or other works. The sole purpose of this policy is to avoid potential misunderstandings or disputes when Sable Systems International\’s products or marketing strategies might seem similar to unsolicited ideas submitted to Sable Systems International. So, please do not market your unsolicited ideas to Sable Systems International or anyone at Sable Systems International. If, despite our request that you not send us your unsolicited ideas, you still send them, then regardless of what your letter says, the following terms shall apply to your idea submission.

Terms of Idea Submission

You agree that: (1) your unsolicited ideas will automatically become the property of Sable Systems International, without compensation to you, and (2) Sable Systems International can use the unsolicited ideas for any purpose and in any way, and even give them to others.
